Problemas del mientras tanto : espera y justicia en la causa “Mendoza”

Abstract

El presente artículo se propone indagar en las relaciones entre la espera y la garantía de derechos en asentamientos informales en el marco de un litigio estructural de saneamiento ambiental, la causa “Mendoza”. Partiendo de los trabajos que han indagado en la relación entre tiempo y dominación política buscará realizar un aporte sobre el carácter activo de los sujetos en los largos períodos durante los cuales se implementan políticas públicas. A través de un trabajo de campo cualitativo en dos asentamientos informales localizados en una de las cuencas más grandes del Área Metropolitana de Buenos Aires (uno en la ciudad de Buenos Aires y otro en el municipio de Lomas de Zamora), se dará cuenta de las maneras en las que el Poder Judicial construyó cotidianamente su poder a través del manejo de los tiempos de los habitantes de estos barrios, y las prácticas que las organizaciones llevaron adelante interpelando sistemáticamente a estas burocracias estatales.

This article aims to investigate the relationship between waiting and guaranteeing rights in informal settlements in the context of a structural litigation, the “Mendoza” case. Starting from the studies that have analyzed the connections between time and political domination, it will seek to make a contribution in relation to the active nature of the subjects in the long periods during which public policies are implemented. Through qualitative field work in two settlements located in one of the largest river basins of the Metropolitan Area of Buenos Aires (one in the city of Buenos Aires and the other in the municipality of Lomas de Zamora), we pretend to shed light to the ways in which the Judiciary builds its power on a daily basis through the management of the time of the inhabitants of these neighborhoods, and the practices that the organizations carried out systematically questioning these state bureaucracies.
